Rules of the Idaho Board of Scaling Practices This is a link to all current administrative rules (Chapter 01 Rules, IDAPA 20.06.01). Administrative rules have the force and effect of law.
*Administrative Rules Revisions Summary*
The Idaho Board of Scaling Practices entered the administrative rulemaking process during summer 2008 to adopt the Idaho Log Scaling Manual and associated rules revisions. This rulemaking became final, effective, and "official" upon conclusion of the 2009 legislative session, on May 8, 2009.
The intent for adopting the Idaho Log Scaling Manual was to replace numerous log scaling measurement rules and references to the National Forest Log Scaling Handbook that were formerly iterated in Chapter 03 "Measurement Rules for Forest Products of the Idaho Board of Scaling Practices" [IDAPA 20.06.03]. The intent of associated rules revisions was to retain unchanged, those former rules addressing methodology of scaling for commercial purposes in Idaho.
The first stage of the rulemaking process involved Negotiated Rulemaking (details were published on page 64 of the July edition of the Idaho Administrative Bulletin).
The second stage of rulemaking involved Proposed Rulemaking (refer to pages 138 through 145 of the September edition of the Idaho Administrative Bulletin).
The third stage was Pending Rulemaking, which involved approval by the legislature. All rulemaking has been completed by the Idaho Board of Scaling Practices and approved by the 2009 Legislature. Rules became final, effective, and "official" upon adjournment of the legislature.
Rules of the Idaho Board of Scaling Practices that govern scale determination in Idaho remain essentially unchanged, but they now reference a new "Idaho Log Scaling Manual" rather than the USFS "National Forest Log Scaling Handbook"
Chapter 03 Rules "Measurement Rules for Forest Products of the Idaho Board of Scaling Practices" [IDAPA 20.06.03] has been repealed (deleted in its entirety)
Revisions were made to Chapter 02 Rules "General Rules, Licensing and Check Scales of the Idaho Board of Scaling Practices" [IDAPA 20.06.02]:
- Renamed to "Chapter 01 - Rules of the Idaho Board of Scaling Practices" [which became IDAPA 20.06.01]
- Reference added for "Idaho Log Scaling Manual" as scaling methodology
- Addition of rules to reflect gross & net scale determination (keeping the same intent formerly reflected in Chapter 03 Rules [IDAPA 20.06.03])
- Technical corrections to existing rules
Resulting rules revisions have all administrative rules of the Idaho Board of Scaling Practices stated in one chapter of rules [which became IDAPA 20.06.01]
The complete text of these Rules revisions can be found on pages 139 through 144 of the September edition of the Idaho Administrative Bulletin. The former Chapter 02 Rules [IDAPA 20.06.02] along with changes made by these Rules revisions are now the current administrative rules of the Idaho Board of Scaling practices, effective May 8, 2009.
